Michael Atkinson

Biography

Mr. Atkinson works tirelessly to provide a variety of financial advisory, consulting, expert witness and fiduciary services to his clients including debtors, their lenders, unsecured creditors, post-confirmation trusts, plan administrators, boards of directors and avoidance action defendants. Having served as chief restructuring officer, chief financial officer and trustee to troubled companies and as financial advisor, expert or accountant in a wide range of bankruptcy and restructuring cases, he continuously brings value to his clients by using strategic creativity to determine what analyses and information are necessary to produce exceptional results. Furthermore, Mr. Atkinson carries robust knowledge in the areas of business stabilization, cash flow improvement, financial projections, strategic business plans, debt restructuring, reorganization plan development, analysis, feasibility and negotiation, pension issues, fraud investigation, solvency analyses, business valuation, detailed liquidation and payout analyses, substantive consolidation issues, asset liquidation, preference actions and claims analyses. His experience covers a wide range of industries including financial services, energy, healthcare & pharmaceuticals, industrials, leisure, mining, real estate, restaurants, retail & consumer products and telecommunications.

Mr. Atkinson has significant expertise in mass tort cases (particularly relating to opioid companies) and has advised creditors in the cases of the only three pharmaceutical manufacturers to file for bankruptcy in the U.S. – serving as financial advisor to the Unsecured Creditors’ Committees of Insys Therapeutics and Purdue Pharma, and as financial advisor to the Opioid Claimants Committee of Mallinckrodt plc. His work on the Mallinckrodt case led him to be selected to serve as Trustee to Mallinckrodt’s Master Disbursement Trust II. Mr. Atkinson’s other work in the mass tort realm includes serving as financial advisor to the Coalition of Abused Scouts for Justice in the Boy Scouts of America case, the Official Committee of Tort Claimants and the Future Claimants’ Representative of Cyprus Mines, as well as the PG&E Fire Victim Trust.

In addition, Mr. Atkinson has led over 50 other creditors’ committee cases and debtor cases in his career and has served, or is currently serving, as a financial advisor in connection with the bankruptcies of Circuit City, Gymboree, Linens ‘n Things, Nine West, True Religion, Alpha Natural Resources, Achaogen, Aegerion Pharmaceuticals, Pernix Therapeutics, Samuels Jewelers, Z Gallerie, Heritage Home Group, American Tire Distributors,  Erikson Retirement Communities, Health Diagnostic Laboratory, Metromedia Steakhouses. In addition, Mr. Atkinson has represented over 30 post-confirmation trusts including those of Toys “R” Us Property Company I LLC, ATA Airlines, Chi-Chi’s, Murray’s Inc. and United Petroleum and has provided testimonies before 14 state and federal courts in various matters.
